~To Dr. Glenn: to Dr. Glenn. learn your california tax law better. Subway can tax their food if it follows these set of rule. which are:Sales of some to-go items are not taxable. They include hot beverages like coffee, hot chocolate and warm tea* and noncarbonated beverages like fruit drinks, milk and iced tea. Cold food products like sandwiches, salads, smoothies and ice cream are not taxable if they are individually wrapped and sold to-go .**However, the sale of a cold food product as part of a package can be taxed. For example, a cold doughnut is taxed if it is part of a package with a hot coffee, warm sandwich or other noncold food.
